Carlos Reyes Construction based in Memphis, IN, has been issued several safety violation citations and fines of $18,400 by the Indiana Department of Labor (IDOL)’s Occupational Safety and Health Administration for problems discovered during inspections of a Jeffersonsville jobsite between Feb. 14 and 18.
Safety inspectors discovered violations at the Villas of Jeffersonville site, reported in a Safety Order and Notification of Penalty issued to the company on March 6. The safety order observed that this is not the first time the company has been cited for the violations.
Alleged violations included:
- $1,200 fine – Repeat violation: On Feb. 14, 2019, during construction activities, inspections of the jobsite, materials and equipment were not performed by a competent person who was able to identify existing and predictable hazards and/or take the necessary steps to correct the hazards where employees were exposed to falls and PPE;
- $3,000 fine – Repeat violation: On Feb. 14, 2019, during construction activities, employees were not instructed in the recognition and avoidance of unsafe conditions applicable to their work environment such as, but not limited to, those connected with the use of safety glasses;
- $3,000 fine – Repeat violation: “On Feb. 14, 2019, during construction activities, I observed eye protection to not be used by four employee(s) using pneumatic nail guns;”
- $10,000 fine – Repeat violation: “On Feb. 14, 2019, during construction activities, I observed the employer allowing employees engaged in framing activities, at a height of approximately 9 feet and 10 feet, to be not protected from falls;”
- $1,200 fine – Repeat violation: On Feb. 14, 2019, during construction activities, employees exposed to fall hazards were not provided with a fall protection training program.
